1. Acceptance of Terms

By installing or using the MediaSurv Roku channel ("Channel"), you agree to these Terms of Use. If you do not agree, do not install or use the Channel.

2. Description of the Channel

MediaSurv is a self-hosted media server platform. The Channel is a Roku client that connects to a MediaSurv server instance that you own, operate, and maintain on your own hardware. The Channel enables you to browse and stream your personal media library on your Roku device.

3. Self-Hosted Nature

You acknowledge that:

• The Channel requires a separately installed and configured MediaSurv server to function.
• You are solely responsible for operating, maintaining, and securing your MediaSurv server.
• The Channel developers do not host, operate, or have access to your server or its contents.
• Server availability, performance, and security are your responsibility.

4. User Responsibilities

You agree to:

• Use the Channel only to access media that you have the legal right to view.
• Comply with all applicable local, state, national, and international laws and regulations.
• Not use the Channel for any unlawful purpose, including but not limited to the distribution or consumption of pirated content.
• Maintain the security of your server credentials and connection details.

5. Intellectual Property

• The MediaSurv name, logo, and Channel software are the property of the MediaSurv project contributors.
• Media content accessed through the Channel belongs to its respective rights holders.
• Metadata and imagery sourced from third-party APIs (such as TMDB) are subject to those services' respective terms.

6. Disclaimer of Warranties

THE CHANNEL IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Channel will be uninterrupted, error-free, or secure.
• The Channel will be compatible with all MediaSurv server versions.
• Any defects will be corrected.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE MEDIASURV PROJECT CONTRIBUTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE CHANNEL, REGARDLESS OF THE THEORY OF LIABILITY.

8. Content Responsibility

You are solely responsible for the media content stored on and served by your MediaSurv server. The Channel developers have no knowledge of, control over, or responsibility for the content you access through the Channel.

9. Modifications

We reserve the right to modify these Terms of Use at any time. Changes will be reflected by updating the "Last Updated" date above. Continued use of the Channel after modifications constitutes acceptance of the updated terms.

10. Termination

You may stop using the Channel at any time by uninstalling it from your Roku device. We reserve the right to discontinue the Channel at any time without notice.

11. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
